NOTICE OF PUBLIC HEARING

Pursuant to chapter 91, Hawaii Revised Statutes, notice is hereby given that the Department of Land and Natural Resources, State of Hawaii, will hold public hearings at the following locations and times on

October 19, 2002, Counties of Hawaii, Maui, Kauai and Oahu:

to consider the proposed amendments to the Hawaii Administrative Rules, Chapters 13-240, 13-243, 13-245, 13-250 and 13-256 as they relate to blue ball graphic, link to draft rules pertaining toocean safety (16K PDF) and blue ball graphic, link to draft rules pertaining totow-in surfing (16K PDF).

The Division of Boating and Ocean Recreation is amending section 13-240-5 to add definitions for "Diver's flag," "Free diver," Personal flotation device," and "SCUBA."

The Division of Boating and Ocean Recreation is amending section 13-243-1 to require that all persons, who are twelve years of age or younger, wear a properly fitted personal flotation device whenever a vessel, whose length is thirty feet or less in length, is underway on the ocean waters or navigable streams of the state or when moored or anchored offshore in a non-designated offshore mooring area.

The Division of Boating and Ocean Recreation is proposing to amend section 13-245-9 as it relates to diver's flag requirements. The dive industry worked with the Division for over two years to update this rule.

The Division of Boating and Ocean Recreation is amending section 13-250-5 that will add definitions for the terms "Global Positioning System (GPS)," and "Tow-in surfing."

The Division of Boating and Ocean Recreation is amending section 13-256-16 that will require a certificate of completion from an accredited institution of higher education on the safe use and operation of a thrill craft by January 2005 for all recreational thrill crafts operators.

The Division of Boating and Ocean Recreation is amending section 13-256-18 that will require the establishment of a safety instruction program for commercial thrill craft operators. This rule will not affect commercial thrill craft operators since they already provide safety instruction for their customers.

The Division of Boating and Ocean Recreation is adopting section 13-256-22 that will establish tow-in surfing rules and areas for the waters only around the islands of Kauai, Oahu and Maui.

All interested parties are invited to attend and to present their views on the proposed amendments, either orally or in writing. Written statements may be submitted at the public hearing or to the Chairperson at any time prior to November 4, 2002.
