Recent Transportation Legislation

During the 2000, the Legislature passed and the Governor signed the following transportation bills:

Act 23

SB 2635 lowers highway vending from misdemeanor to petty misdemeanor and extends definition of crime to include the risk of creating a hazardous condition or public nuisance. Effective: 4/19/00.

Act 62

HB 1757 removes the trailer exemption from prohibitions relating to passengers or consumption of intoxicating liquors in motor vehicles. Conforms Hawaii’s open container law to TEA 21 Section 154 requirements. Effective: 4/27/00.

Act 86

HB2615 amends the definition of hazardous material on state highways to bring the state into compliance with federal requirements. Effective: 4/27/00.

Act 100

HB1457 recrimanalizes improperly secured load violations. Effective 7/1/00.

Act 111

HB 2643 allows the counties to increase fees, from $2 to a maximum of $5, for certificates of registration for motor vehicles other than U-drive motor vehicles, provided that any additional fee increase over $2 is to be expended only to defray the additional cost in the disposition and other related activities of abandoned or derelict vehicles. Effective 5/22/00.

Act 189

HB 1881 part 1 reduces jail time for DUI drugs. Part 2 provides for revocation of motor vehicle registration for repeat intoxicated drivers under the administrative revocation of driver’s licenses proceedings as required by Section 164 of TEA 21. Part 3 amends driving impaired statutes to consolidate and conform offenses relating to operating a vehicle while using an intoxicant. Effective: Part 1, 6/8/00; Part 2, 9/30/00; Part 3, 1/1/02.

Act 240

HB 1759 extends length of the three-year photo red light imaging and photo speed imaging detector demonstration project for two more years. Allows the use of photo technology systems to identify drivers in violation of designed uses of high occupancy vehicle lanes. Authorizes the department of transportation to retain and pay contractors for the project. Establishes the traffic enforcement demonstration project. Appropriates funds. Makes other housekeeping changes. Effective: 7/1/00.

Act 255

HB 1763 requires bicycle riders under 16 to wear a bicycle helmet. Effective: 1/1/01.

Act 293

HB 286 establishes fines for motorists who are convicted of driving their motor vehicles at speeds greater than the maximum speed limits established for construction areas. Effective: 7/3/00.

Act 294

SB 2311 increases fine from $20 to $45 for each violation of mandatory seat belt use; requires backseat passengers between the ages of four and seventeen to use seat belts. Effective: 7/3/00.

Act 296

SB 3073 adds habitual driving offense to implied consent law. Defines a preliminary alcohol screening device and clarifies that its use is not a substitute for a test under the implied consent law. Effective: 7/3/00.
